SALISBURY — The Wicomico County Fraternal Order of Police filed a lawsuit in circuit court today over the collective bargaining labor code approved by the county, arguing it fails to uphold the intent of referendum to authorize binding arbitration not subject to county leaders.

The bill, which allows deputies at Lodge #111 to request a third-party arbitrator to negotiate a better benefits and disabilities package, was vetoed by County Executive Rick Pollitt in January because he described it as toothless. Pollitt argues that without an arbitrator's decision binding both himself and the Wicomico County Council, it is meaningless.

"Their position is legally valid, but the difference is that my way follows the results of the referendum and the council's way falls short of that," Pollitt said in January.

Sheriff's deputies fought for salary and benefits negotiating power in order to negotiate for better retirement and health plans. In 2006, county voters supported that desire by referendum — a 2-to-1 margin. The council argues that if the legislature were to get involved in negotiations, which it is prevented to do for all other county matters, it would violate the charter.

“ The FOP respects the County Council’s position to retain the checks and balances of the County Government; however, we believe that the labor code as adopted does not follow the will of the voters of Wicomico County,” according to a news statement from the FOP.
